Supreme Court Denies Bail To Sadaqat Khan

On Tuesday the District Court of Indore dismissed the bail-in plea of a 23-year-old man who, following a comedy show, was arrested along with stand-up comedian Munawar Faruqui.

Sadaqat Khan (23), charged with participating in the organization of the display, moved the courts of sessions seeking bail on the grounds of 'parity,' which had been granted a temporary bail by the Supreme Court four days earlier, as Mr Faruqui had been charged.

Yatindra Kumar Guru denied his invitation for further sessions. On 11 January, the court dismissed his first bail application.

Since 3 January after his arrest Mr. Khan, a Mumbai-based civil engineer, has been in a local jail. Only Mr. Faruqui and another guy – a minor – are under fire from six people who have been arrested in the case.

In the order passed on Tuesday the additional meetings judge quoted previous decisions of the Supreme Court and confirmed that the granting of the bail would not be required by law.

The Supreme Court's February5 order grants Mr Faruqui bail, Mr. Khan's counsel Surendra Kumar Verma said his client should get bail 'on the basis of legal parity.'

However, Sanjay Sharma, the additional public advocate, objected that the order of Mr. Faruqui's apex court was provisional and Mr. Khan was unwilling, on his grounds, to call upon the theory of parity.

On 1 January, in a complaint lodged with Eklavya Singh Gaud, son of local BJP MLA Malini Laxman Singh Gaud, the comedian Faruqui and five others engaged in the organization of a show in Indore were arrested.

The son of the MLA alleged that inappropriate remarks were made during the display concerning the Hindu deities and Union Home Minister Amit Shah.

In the meantime, the bail hearing is scheduled for 12 February for the other two who were arrested by Prakhar Vyas and Edwin Antonio. The court issued Prakhar's brother bail because he was a young man. Ajay Bagadiye, Prakhar's counsel, said two charges against Prakhar were present. The Police has said that between March 2020 and January 21 this year, 18 calls had taken place between Prakhar and Munawar, according to police. Secondly, according to Bagadiya, the police say that Prakhar appeared either before or immediately after Munawar on stage and supposedly made remarks that interrupted communal harmony.
