CBI Questions UP Police’s Fortification, Confirms Hathras Victim Was Raped

The Hathras case which turned several accusations on Uttar Pradesh police and government had now taken another turn. Contradicting the UP police’s claim that Manish Valmiki was not raped, the CBI has now confirmed the rape and murder of the 19-year-old girl.

CBI has filed a chargesheet against all the four accused in the case making it crystal clear that the UP police tried to manipulate the case, though it failed today after certain efforts.

The chargesheet Sections 376 (rape), 376 (D) (gangrape), 302 (murder) and relevant Sections of the SC/ST Act, against accused Sandeep (20), his uncle Ravi (35) and their friends Ramu (26) and Luv Kush (23).

The case was registered by CBI on 11th October 2020 after requests from the Uttar Pradesh government and the government of India.

CBI has filed the case in Court of Special (SC/ST Prevention of Atrocities Act) B D Bharti in Hathras and also invoked charged against the four accused.

According to sources, “The only charge that has been dropped is of molestation, but that is because the charge of rape and gangrape has been found during forensic investigation. The investigation showed enough evidence to prosecute on the charges of murder, rape and gangrape.” 

The accused’s lawyer has been demanding the addressal and to grant bail but now has come up with another statement. The lawyer stated “It is now up to the court to deliberate on the charges. A copy of the chargesheet will be provided at the next hearing. We will go through the chargesheet and decide the next course of action.”

#manishavalmiki, a 19-year-old girl was brutally gang-raped on 14th September when she went to collect cattle fodder. She was dragged by her dupatta which also led to fracturing her spinal cord. She was first admitted to Aligarh hospital and then escorted to Safdarjung hospital in Delhi.

Doctors confirmed that she had several major injuries and her tongue was cut. The girl after struggling for fortnight died on 29th September 2020.  Manisha’s body was cremated at midnight, the UP police did not consult her family before performing her last riots which put a question mark on the functioning of police in one of the largest Indian states.

While the police was adamant of no rape, the Allahabad High Court concluded “mere absence of semen during forensic examination, though a factor for consideration, would not by itself be conclusive as to whether rape had been committed or not, if there are other admissible evidence”

As the news appeared on TV screens, several political parties, activists and students without watching their six began protesting demanding #justiceformanishavalmiki. Congress leaders Rahul Gandhi and Priyanka Gandhi travelled to Hathras when they were forced and attacked by the police. Bhim Army Chief Chandrashekhar Azab was also seen demanding justice for the girl.

 

Meanwhile Indians demanded resignation of Yogi Adityanath as his government failed.
