#JusticeinJeopardy: United States executes first woman in 67 years

The notion of justice seems to again be in a state of jeopardy with the United States executing the only woman on the federal death row. The United States executed the first woman since 1953. It was approved by the trump administration. The stay order was denied by the Supreme Court:

Lisa received a lethal injection at a prison in Terre Haute, Indiana, after a last-minute stay of execution was lifted by the US Supreme Court. Lisa was accused of killing a pregnant 23 year old Bobbie Jo Stinnett by strangling her and cutting out her baby.

When asked about her last words, she simply replied with a "NO".

Montgomery's lawyer, Kelley Henry stated ""The government stopped at nothing in its zeal to kill this damaged and delusional woman," she said in a statement. "Lisa Montgomery's execution was far from justice."
 

Her execution was delayed due to the COVID 19 Pandemic and then by a judge who had ruled in her favour.

The Crime:

Lisa Montgomery was convicted in 2007 in Missouri for the kidnapping and strangling Bobbie Jo Stinnett, an eight months pregnant woman. Lisa Montgomery cut Stinnett's fetus from the womb and strangled her. Although the child survived the deadly incident, the mother didn’t. The Police found Lisa cradling a new born girl she claimed to have given birth to the day before. After her story fell apart, she confessed to the killing.

Then why the Solidarity ?

As a child she was routinely sexually and physically abused by her father and trafficked by her mother, family members proclaimed. Her treatment was so violent that it amounted to torture, as per her lawyer Kelly Henry pictured below:

Her defence team also believed that at the time of her crime, Montgomery was psychotic and out of touch with reality. That opinion was supported by 41 current and former lawyers as well as human rights groups like the Inter American Commission on Human Rights.

According to interviews with her half-siblings and others who spent time with the family, published by the BBC : "Montgomery's stepfather built a shed onto the trailer where he, and eventually his friends, raped and beat her. Her mother also began trafficking her, allowing handymen like electricians and plumbers to sexually abuse

Montgomery in exchange for work on the house. As a teenager, Montgomery confided in a cousin, telling him the men would tie her up, beat her and even urinate on her afterwards. But the cousin, a sheriff's deputy, confessed to Montgomery's current legal team that he did nothing. In fact, he drove her back home and dropped her off in the hands of her abusers."

However, there is little place for such arguments in a country like the United States where the support for capital punishment is at its highest since decades. Also, what needs to be considered here is the brutal state in which the victim was killed. "She bled to death" reported the media outlets.

The incident has gained recognition in the popular culture aswell with it being the subject matter of books and criminal television shows.

What we need to understand that Law and Justice are two different aspects. Law may not necessarily provide justice but still is a means to get there. Take for example the Nirbhaya case which shook the country of India to its core. One of the major perpetrators of the crime walked free because he was a juvenile. So was Justice achieved ? Certainly not. But the rule of law definately prevailed. There exists a fine line between the two.

The subject of capital punishment has become a prevailing issue of debate in the developing world. A conclusion needs to be derived but that would certainly require a lot of evaluation and analysis.
