Supreme Court Nullifies Charges Against Munawar Faruqui

The Supreme Court has granted interim bail to comedian Munawar Faruqui regarding the case related to disrespecting Hindu sentiments and allegedly defaming Hindu gods.

Bar and Bench reported that a bench of Justices Rohinton Fali Nariman and BR Gavai further stayed the UP Police’s production warrant against the comedian.

 

The Supreme Court contradicted the HC’s plea which observed “The evidence/material collected so far suggest that in an organised public show under the garb of standup comedy at a public place on commercial lines, prima facie; scurrilous, disparaging utterances, outraging religious feelings of a class of citizens of India with deliberate intendment were made by the applicants.”

 

Madhya Pradesh Indore bench that previously ordered the stay of the comedian’s arrest stated that the collected evidence against Munawar indicates religious outrage and hurting Indian sentiments with an intent.

 

The High Court while dismissing the bail plea stated “There is also a specific assertion by the learned counsel for the complainant that the applicant along with other co-accused persons allegedly making outraging filthy jokes in social media deliberately against Hindu Gods, Lord Shri Ram and Goddess Sita hurting religious sentiments of Hindus for the last 18 months despite, protest on various social media platforms. There is nothing on record to the contrary.”

 

Even though Faruqui’s lawyer alleged that the accused did not make any comments with the intent to hurt religious sentiments, the Madhya Pradesh HC rejected the plea.

 

There were further allegations regarding Faruqui’s comments in a show held on May 2020.

 

Justice Rohit Arya while declaring Faruqui’s sentences said “be that as it may, this Court refrains from commenting upon contentions of the parties touching on merits but, regard being had to the material seized and the statements of the witnesses and that the investigation is in progress, no case is made out for grant of bail.”
